What is Conveyancing?
Conveyancing is the legal work associated with the sale, purchase, transfer, assignment, lease, or mortgage of land. When acting for a vendor, this includes preparing a contract for sale, negotiating with the solicitor representing the purchaser, and acting for the vendor on settlement of the sale of property. When acting for a purchaser, this includes reviewing and advising upon the contract for the sale and purchase of land, negotiating with the solicitor representing the vendor, for those authorised by Revenue NSW – processing an application for assessment through the electronic returns system and directing payment of stamp duty, and acting for the purchaser on settlement of the purchase of property.
In many circumstances, the work associated with a conveyance can be performed by either a solicitor or a licensed conveyancer

The main difference between a solicitor and conveyancer is that, as a lawyer, a solicitor is able to advise on a greater range of aspects related to the sale and purchase of land. This includes, but is not limited to, advising on and acting for you in relation to a mortgage agreement and a building contract.
In the event that a contract for the sale and purchase of land is breached, only a solicitor is able to provide legal advice on your potential legal remedies and act for you in enforcing the contract for the sale and purchase of land. This may include suing the breaching party for damages or specific performance.

During the stage of negotiating a purchase price, you should contact a solicitor to act for you in relation to the purchase of the property.
